Terms & Conditions
1. Introduction
These Terms & Conditions govern the provision of services by Studio CREART. By engaging Studio CREART for any design, branding, web design, website development, packaging or related services, the Client agrees to be bound by these Terms & Conditions.

2. Services & Payments

All projects require an approved quotation or invoice before work commences.

A deposit payment is required before any work begins unless otherwise agreed in writing.

Work will commence only after the required deposit has been received.

Final files, website access or deliverables will not be released until full payment has been received.

3. Non-Refundable Deposits
Deposits are non-refundable if the project is cancelled, delayed or left incomplete due to the Client's decision, lack of communication, failure to provide required materials or any other reason beyond Studio CREART's control.

4. Revisions & Approvals
Each project includes two (2) rounds of revisions, unless otherwise agreed in writing. Additional revisions, amendments or changes requested beyond the included revision rounds will be charged at the applicable hourly rate.​​​

​​5. Client Responsibilities
The Client is solely responsible for providing all content, including but not limited to:

text
-
logos
-
photographs
-
illustrations
-
product information
-
pricing
-
contact details
-
legal notices
-
policies
-
and any other materials required for the project.
The Client confirms that all information supplied is accurate, complete and up to date. Studio CREART accepts no responsibility for errors, omissions, inaccuracies or legal issues arising from materials or information supplied by the Client.

6. Client Approval
The Client is responsible for carefully reviewing and approving all designs, artwork, branding, packaging, website content, spelling, grammar, pricing, dimensions, contact details and any other project materials before production, printing, publication or website launch.
Once final approval has been provided by the Client, Studio CREART accepts no liability for any errors contained within the approved materials.
Any changes requested after final approval may incur additional charges.

7. Project Scope
Any work requested outside the agreed quotation or project scope shall be treated as additional work and billed at the applicable hourly rate.
This includes, but is not limited to:

additional design concepts;
-
new pages;
-
additional revisions;
-
copywriting;
-
image sourcing;
-
content updates;
-
website edits;
-
technical support;
-
training;
-
print assistance;
-
domain administration;
-
hosting administration;
-
or changes resulting from new instructions or materials supplied after work has commenced.

8. Hourly Rate
Unless otherwise stated in the quotation, additional work is charged at:

1,000 CZK / hour
-
40 EUR / hour
-
45 USD / hour
-
35 GBP / hour

9. Third-Party Services
Where the Client places orders directly with third-party providers, including but not limited to Canva Print, commercial printers, hosting providers, domain registrars, Shopify, Wix, WordPress or any other external service, Studio CREART is not responsible for:
-
product specifications;
-
printing dimensions;
-
print quality;
-
production errors;
-
delivery;
-
platform functionality;
-
hosting performance;
-
technical limitations;
-
or any errors resulting from the Client's own selections, approvals or actions.
Studio CREART accepts no liability for services, products or functionality provided by third parties.

10. Domains & Hosting
Domain registrations are provided only for the registration period stated on the relevant invoice.
Unless expressly agreed in writing, Studio CREART does not provide:

renewal reminders;
-
automatic renewals;
-
DNS management;
-
hosting administration;
-
website maintenance;
-
ongoing technical support;
-
monitoring of domain or hosting services.
Domain transfers, DNS configuration, hosting assistance and other administrative services are available upon request and may be subject to additional fees.

11. Intellectual Property
Ownership of the final approved design work transfers to the Client only after full payment has been received.
Studio CREART retains ownership of all preliminary concepts, drafts and unused design proposals unless otherwise agreed.
Studio CREART reserves the right to display completed work in its portfolio, website and promotional materials unless otherwise agreed in writing.

12. Overpayments & Incorrect Transfers
If the Client sends an overpayment or pays an incorrect amount or currency, the payment received will first be allocated towards any outstanding invoices, deposits or completed work.
Any remaining balance will be refunded only after both parties confirm the final amount.
Refunds may differ due to:

bank fees;
-
payment processing fees;
-
exchange rate differences;
-
international transfer charges.
All costs arising from incorrect payments remain the responsibility of the Client.

13. Currency & Exchange Rates
Invoices are issued in the currency agreed with the Client (CZK, EUR, USD or GBP).
If payment is made in a different currency, the amount received will be converted according to Studio CREART's bank exchange rate on the date of receipt.
All accounting is based on the net amount received in the invoiced currency.
Any losses arising from exchange rates, bank conversion fees or payment processing fees remain the responsibility of the Client.

14. Limitation of Liability
Studio CREART shall not be liable for:

indirect or consequential losses;
-
loss of revenue;
-
loss of profit;
-
business interruption;
-
third-party claims;
-
or any damages arising from the use of completed work after delivery.
The Client accepts full responsibility for ensuring that all approved materials are suitable for publication, printing and commercial use.

15. Termination
Either party may terminate the project by providing written notice.
Payments already made, including deposits, remain non-refundable.
If a project is delayed, suspended or cancelled due to the Client's lack of communication, failure to provide required materials or failure to make payments, Studio CREART reserves the right to invoice for all work completed up to the termination date.
Where a payment due date needs to be amended, this must be agreed in writing by both parties.

15. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
